Cet article s’attache à décrire l’évolution dans l’amitié entre Chŏng Yakyong et Yi Kigyŏng. Beaucoup de choses les rapprochaient, objectivement. Tous deux étaient de brillants lauréats du concours du doctorat de 1789, tous deux étaient membres de la même faction politique, les Namin (les ''Sudistes''), tous deux étaient fonctionnaires civils à la cour du roi Chŏngjo ( r. 1776-1800) dans la Corée de l'ère Chosŏn (1392-1897), et tous deux jouèrent un rôle important dans cette période de grands changements, à la (...) fois socio-politiques, religieux, culturels et intellectuels, que vécut alors la Corée. Chŏng Yakyong s’intéressa à de nombreuses branches différentes du savoir occidental qui parvenait alors à la Corée, et il embrassa même, brièvement après sa confession, la foi chrétienne en 1784. Se sentant critiqué et calomnié, il la renia publiquement en 1797, mais son ami Yi Kigyŏng, auteur du Pyŏgwip’yŏn 闢衛編 ( Compilation de documents pour le rejet de l’hétérodoxie et la défense de l’orthodoxie ), ne voulut jamais y croire. Cet ami devint même un ennemi au point qu’il l’attaqua violemment, en 1801, ce qui valut à Chong Yakyong un long et douloureux bannissement jusqu’en 1818. À travers la lecture des textes dont nous disposons, officiels et personnels, nous tentons de comprendre ce qui s'est joué alors et d'analyser l’évolution de leur amitié face à ce qui les divisa – ces événements qui furent tragiques pour beaucoup de monde. Upshot: The authors propose that a perspective is an autopoietic system. This commentary challenges the feasibility of this claim by pointing out the conceptual difficulties associated with such a proposal. But even granting that a perspective is, or can be, an autopoietic system, what sort of autopoietic system might best ground the authors’ concept of perspective? Laland and colleagues have sought to challenge the proximate–ultimate distinction claiming that it imposes a unidirectional model of causation, is limited in its capacity to account for complex biological phenomena, and hinders progress in biology. In this article the core of their argument is critically analyzed. It is claimed that contrary to their claims Laland et al. rely upon the proximate–ultimate distinction to make their points and that their alternative conception of reciprocal causation refers to phenomena that were already accounted (...) for by standard theory. Upshot: I draw connections between the target article and the broader literature on interdisciplinarity, highlighting areas of both agreement and disagreement. Suggestions are made regarding how interdisciplinary research should proceed.

Strange Tools foregoes stolid conventions of professional philosophy, laudably broadening the book’s appeal to accommodate a popular audience. However, Noë’s manner of glossing over complex issues about art does not necessarily render these topics intelligible to philosophical novices. Instead, his oversimplifications will tend to confirm naïve notions that art is straightforward – a common misconception that a foray into philosophy of art ought to dispel, not corroborate.

This paper explores the ethical and conceptual implications of the findings from an empirical study (reported elsewhere) of decision-making capacity in anorexia nervosa. In the study, ten female patients aged thirteen to twenty-one years with a diagnosis of anorexia nervosa, and eight sets of parents, took part in semistructured interviews. The purpose of the interviews was to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. All the patient-participants were also tested using the (...) MacArthur Competence Assessment Tool—Treatment test of competence. This is a formalized, structured, interviewer-administered test of competence, which is a widely accepted clinical tool for determining capacity. The young women also completed five brief, self-administered questionnaires to assess their levels of psychopathology. The issues identified from the interviews are described under two headings: difficulties with thought processing and changes in values. The results suggest that competence to refuse treatment may be compromised in people with anorexia nervosa in ways that are not captured by traditional legal approaches. (shrink)

Context: Current theories of art, particularly those developed from a neuroscientific perspective, fail to take adequate account of the role, methods or motivations of the artist. The problem is that the lack of the artist’s voice in interdisciplinary theoretical research undermines the basis of current theoretical models. Problem: How can artists purposefully engage with contemporary consciousness studies? The aim of the research was to develop new methodologies appropriate for cross-disciplinary research and to establish what value, if any, neuroaesthetic or phenomenological (...) theories of art could hold for contemporary arts practice. Method: My approach to the topic was to explore the application of neuroaesthetic and phenomenological theory through practice-based research in contemporary art. Results: The paper maps out a proposed avenue of research, and some initial findings, rather than the results of an inquiry. Implications: This paper will be of interest to those who work in philosophy of art and visual perception and those who are exploring empirically-based research methodologies in philosophy. Insights will be beneficial to arts practitioners, philosophers and scientists researching aesthetic experience. Constructivist content: The paper explores Noë’s sensorimotor theory of perception and the extended temporal relation between visual elements of an artwork as its forms are created in consciousness. Open peer commentary on the article “Observing Environments” by Hugo F. Alrøe & Egon Noe. Upshot: We discuss the environmental terminology of Jakob von Uexküll in the context of Alrøe Egon Noe’s reflections, and to examine more deeply the multi-perspectivity that arises from a combination of von Uexküll’s and Luhmann’s systems theories. The complexity yielded by an unpacking of the term “environment” sheds light on the difficulties in finding common understandings for solving wicked problems.

Gordon's emphasizes that the process of prosecution is crucial to the idea of crime. One who commits a public wrong is properly called to public account for it, and the criminal trial constitutes such a public calling to account. The state is the proper prosecutor of crimes: since a crime is ‘our’ wrong, rather than only the victim's wrong, it is appropriate that we should prosecute it, collectively. The case is not simply V the victim, or P the plaintiff, against (...) D the defendant. It is brought, as the Americans properly have it, by ‘the People’, or by ‘the Commonwealth’, against the defendant. This is a useful way in which to think about crimes and criminalisation. This chapter tries to develop this conception of public wrongs a little further, which also involves complicating it more than a little. It works from a version of liberal communitarianism that rejects the metaphysical version of the individualist's ‘unencumbered self’; but the account sketched here should be compatible with all but the most radically individualist kinds of liberal theory. In response to Lawrence Solum's advocacy of a ‘virtue–centred theory of judging’, I argue that there is indeed important work to be done in identifying and characterising those qualities of character that constitute judicial virtues – those qualities that a person needs if she is to judge well (though I criticise Solum's account of one of the five pairs of judicial vices and virtues that he identifies – avarice and temperance). However, Solum's more ambitious claims – that a judge's vice (...) necessarily corrupts her decisions, and that in at least some contexts we must define a legally correct decision as one that would be reached by a virtuous judge – should be rejected: we can undermine the former by attending to the requirements of due process, and the latter by attending to the ways in which a judge would try to justify her decision. Robert Sharpe examines the humanist conception of music as a language--as expressive and intelligible--which has been a dominant theory in Western culture. He argues against the view that music is expressive by causing certain states in us. Rather, he contends that our beliefs about music are integral to our appreciation of it. Differences in musical taste are then not just irresolvable differences in sensitivity, but the result of variations in circumstance and upbringing, of associations and ideology.

Suetonius quotes at Tiberius 21. 4–7 a number of passages from letters of Augustus to Tiberius showing the high regard in which he professed to hold him, despite his reservations about the darker side of his character, once he had decided to adopt him ‘rei publicae causa’ in a.d 4. They seem to have attracted little critical comment, although Seager connects them with the handling by Tiberius of the Pannonian revolt in a.d. 6–9. suggesting that in view of their fulsome (...) character they were probably written towards the end of this period, when the crisis was past, rather than earlier when Augustus may have been critical of Tiberius’ caution in prosecuting the war. But he does not attempt a more detailed appraisal of the possible dates of the individual letters quoted. Sections 21. 4 and 5 in particular present interesting textual difficulties, mainly arising from the transmission of Greek in a predominantly Latin text: this article discusses these with a view to throwing greater light on the historical significance of the letters. Philosophers and historians of the French Revolution have seen Rousseau's influence as the decisive link between the doctrines of the Enlightenment and the practice of its revolutionary disciples. Professor Leigh here addresses the bibliographical foundations of that question, without which all attempts to settle it in the past have lacked authority. Introducing the most advanced techniques to identify variant and pirate editions of Rousseau's writings, he establishes that there were at least 28 separate imprints and an additional 12 reprints of (...) the Contrat Social in collective editions between 1762 and 1783. Professor Leigh shows also that Rousseau's life and thought excited a fascination and interest in the last years of the Ancien Regime which was nursed by the publishers of his Oeuvres, who sought to satisfy an apparently ceaseless demand by extending their editions, while at the same time attempting to ward off both their creditors and their imitators. In this note I have presented the essentials of a view of how laws are falsified, a view which has been held by some notable philosophers but which is radically opposed to that of Professor Popper. I have not scrupled to ?improve? upon it, so the view of no one philosopher is presented. I try to show that an interesting and convincing account of scientific simplicity is implicit in the theory and I conclude by suggesting how we can bring the (...) argument to bear on the problem of the logical status of laws of nature, showing that through their manner of falsifiability, laws share some characteristics with necessary statements as well as with empirical generalizations. Three arguments are proposed against the idea that ordinary talk about the mind constitutes a folk psychology, a sort of prescientific theory which explains human behaviour and which is ripe for replacement by a neurological or computational theory with better scientific credentials. First, not all talk of the mind is introduced to explain in the way assumed by those who think that mental talk hypothesizes inner processes to explain behaviour. Second, the individuation of the behaviour which is explained by the (...) inner processes itself requires reference to ?mental? states such as intentions or desires. Consequently the project is circular. Finally, scientific theory is a practice with a history which may be matched in the case of ordinary talk of the mind. Certainly ordinary talk of motives, intentions, and thoughts may be infected by the theorizing of economists and sociologists et al., but it is impossible that all talk of the mind should be theoretical in this way. The Model Penal Code’s ‘De Minimis’ provisions (§ 2.12) cover different kinds of case in which, for reasons of equity, a prosecution should be dismissed. An exploration of these different cases illuminates some general issues about the structure of the criminal process, and about the processes of criminalization. These include the significance of the difference between dismissing a case and acquitting the defendant, and of the distinction between offences and defences; whether criminal offences should always be so defined that they (...) specify at least a pro tanto wrong, or may sometimes legitimately specify only a prima facie wrong – and whether this is consistent with the presumption of innocence; what kinds of conduct we can properly be expected to answer for in a criminal court; and the proper division of responsibilities between legislatures, prosecutors and courts in determining what kinds of conduct are to be defined and treated as criminal wrongs.
